1. Our Agreement

Who We Are

Batch LLM is operated by:

What We Do

Batch LLM helps you process CSV and Excel files through AI language models. You upload a file, create a prompt template, and we run your prompts through third-party AI services like OpenAI, Anthropic, and Google using their batch processing APIs.

Your Agreement

By using Batch LLM, you agree to these terms. If you don't agree, please don't use our service.

Changes to Terms

We may update these terms. We'll notify you of material changes via email at least 30 days before they take effect. Continued use after changes means you accept the new terms.

2. Account Types and Plans

Free Plan

Our free plan includes:

• Processing of 100 free rows for testing the service
• Access to one LLM model only
• Cannot select different models or providers
• Email verification is required
• No credit card required

Paid Plan

Paid users:

• Purchase credits in advance (minimum $5)
• Access to all available AI models and providers
• Credits charged based on actual token usage after processing

3. Payment and Pricing

How Pricing Works

Our pricing has three components:

1. Base Cost: AI provider's batch API pricing (exact tokens used)
2. Batch Discount: 50% discount applied by AI providers for batch processing
3. Service Fee: 15% fee added to cover our infrastructure and support

Formula: Final Cost = (Base Cost × 50%) × 115%

Credit System

• Credits are prepaid and stored in USD
• Credits never expire
• Minimum purchase: $5.00
• Credits are non-transferable between accounts
• Promotional credits (if any) may have different terms

Payment Processing

• Payments processed securely through Stripe
• By paying, you agree to Stripe's Terms of Service
• We don't store your credit card information

Account Balance and Overdraft

How Charging Works:

• Batch processing charges are calculated after completion
• Your account balance can go negative if processing costs exceed available credits
• You'll receive email notification when balance goes negative

When Account is Negative:

• All your uploads are locked and results become inaccessible
• You cannot download results or view completed rows
• You can still add credits to restore access
• Your data is not deleted - it's just temporarily inaccessible

Restoring Access:

• Add enough credits to bring balance to zero or positive
• Access is restored immediately upon payment
• All previously locked uploads become accessible again

Refund Policy

Unused Credits:
- Refundable within 1 year of purchase
- Contact us via email to request refund
- Processed within 5 business days
- Actual refund timeline depends on Stripe/your bank

Used Credits:
- Cannot be refunded (service already provided)
- This includes completed processing jobs

Disputed Charges:
- Contact us first before filing payment disputes
- We'll work with you to resolve issues
- Chargebacks may result in account suspension

4. Using Our Service

Account Requirements

• Accurate registration information required
• Must be 18 years or older
• Keep your password secure and confidential
• Notify us immediately of unauthorized access

Acceptable Use

You may not:

• Violate any laws or regulations
• Violate third-party AI provider terms of service
• Upload malicious code, viruses, or harmful content
• Attempt to reverse engineer, hack, or overload our systems
• Share account credentials with others
• Process content that:
• Violates copyright or intellectual property rights
• Contains personal information without consent
• Is used for harassment, discrimination, or harm
• Violates OpenAI Usage Policies or Anthropic Usage Policy

Content Monitoring

• We may monitor prompts and results for compliance
• AI providers may also review content per their policies
• We may suspend service for policy violations
• Violations will be documented in our systems
• Repeat violations may result in permanent termination

Service Limits

• Maximum 1,000 rows per uploaded file
• File size limited to 10MB
• Rate limits apply to prevent abuse
• Batch processing may take up to 24 hours

5. Data and Privacy

Privacy Policy

Our Privacy Policy details how we collect, use, store, and protect your data. By using Batch LLM, you also agree to our Privacy Policy.

Your GDPR Rights

As a Poland-based service, we comply with GDPR. You have the right to:

• Access: Request a copy of your personal data
• Rectification: Correct inaccurate personal data
• Erasure: Request deletion of your data
• Portability: Export your data in machine-readable format
• Object: Object to certain data processing activities

Data Processing for Service Delivery

By using the service, you authorize us to:

• Process your uploaded files and prompts
• Send your prompts to AI providers you select
• Store results and make them available to you
• Share necessary data with Stripe for payment processing

All data processing follows our Privacy Policy and applicable data protection laws.

6. Intellectual Property

Your Content Ownership

• You retain all rights to your uploaded files
• You retain all rights to your prompts
• AI-generated results belong to you (subject to AI provider terms)
• We claim no ownership of your content

Our Property

• The Batch LLM service, website, and software
• Our brand, logos, and documentation
• Service improvements and features

License You Grant Us

By using the service, you grant us a limited license to:

• Store and process your files
• Display your content to you
• Send your prompts to AI providers you select
• Make technical copies for backups and redundancy

This license ends when you delete your content or terminate your account.

7. Service Availability

No Uptime Guarantee

• We aim for high availability but don't guarantee 100% uptime
• Service may be interrupted for maintenance
• We depend on third-party AI providers and infrastructure

Batch Processing Times

• Processing may take up to 24 hours
• Email notification sent when processing completes
• Processing time depends on AI provider capacity

Service Modifications

• We may add, modify, or discontinue features

8. Disclaimers and Limitations

"As Is" Service

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DON'T GUARANTEE:

• Accuracy of AI-generated results
• Error-free operation
• Uninterrupted service
• Compatibility with your specific use case

AI Limitations

Important: Language models can "hallucinate" – they sometimes generate incorrect, inconsistent, or completely fabricated information. Always verify critical outputs before use.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We're not liable for indirect, incidental, or consequential damages
• We're not liable for lost profits, data, or business opportunities
• Our total liability is limited to the total fees you paid in the last 12 months

9. Account Termination

Your Right to Terminate

You may terminate your account at any time by:

• Requesting account deletion in settings

Before terminating:
- Download any data you want to keep
- Request refund for unused credits (if applicable)

Our Right to Terminate

We may suspend or terminate your account if you:

• Violate these terms
• Have a negative balance for more than 90 days
• Abuse the service or engage in fraud
• Use the service for illegal purposes

Notice:
- We'll provide 7 days notice for non-emergency terminations
- Immediate termination for serious violations (fraud, illegal content)
- You may appeal termination by contacting support

Effect of Termination

After termination:

• Service access is immediately revoked
• Data deleted within 30 days
• Unused credits can be withdrawn (contact us via email)
• Some records retained for legal/tax purposes
• You remain liable for outstanding charges

10. Legal Terms

Governing Law

These terms are governed by Polish law. Any disputes will be resolved in courts of Lubin, Poland.

Dispute Resolution

Before legal action:
- Contact us to resolve the issue informally
- We'll respond within 5 business days
- Good faith effort to resolve disputes

Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Batch LLM.
